Terms and Conditions for Foritz Travel
Effective Date: July 11, 2025
1. Agreement to Terms By accessing our website or using our services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.
2. Services Description Foritz Travel provides luxury European travel planning services, including but not limited to:
Custom itinerary planning and design
Travel booking and coordination services
Concierge services and ongoing support
Specialized golf, culinary, and cultural tours
3. Independent Contractor Status Foritz Travel acts as an independent travel planning consultant. We are not employees, agents, or representatives of airlines, hotels, tour operators, restaurants, or other travel suppliers ("Suppliers").
4. Booking and Payment Terms
Payment Schedule:
Complete Itinerary Planning: 50% retainer required, balance due 30 days before departure
Concierge Services: Annual membership payable in full or quarterly installments
Specialized Tours: 40% retainer required, balance due 45 days before departure
Payment Methods: We accept major credit cards, bank transfers, and certified checks.
Late Payments: Late payments may result in service delays or cancellation.
5. Cancellation and Refund Policy
Client Cancellations:
More than 60 days before departure: 50% refund of planning fees paid
30-60 days before departure: 25% refund of planning fees paid
Less than 30 days before departure: No refund of planning fees
Supplier Costs: Non-refundable supplier costs (flights, hotels, tours) are subject to individual supplier cancellation policies.
Travel Insurance: We strongly recommend comprehensive travel insurance to protect against unforeseen circumstances.
6. Our Responsibilities We will:
Provide professional travel planning services with reasonable care and skill
Make bookings as requested and confirmed by you
Provide accurate information to the best of our knowledge
Offer 24/7 emergency assistance during your travels
7. Client Responsibilities You are responsible for:
Providing accurate information for bookings and travel documents
Obtaining valid passports, visas, and required documentation
Arriving at airports, hotels, and appointments on time
Following health and safety guidelines for your destinations
Purchasing appropriate travel insurance
Payment of all fees according to agreed terms
8. Limitation of Liability Foritz Travel's liability is limited to the amount of planning fees paid. We are not responsible for:
Acts, omissions, or negligence of Suppliers
Flight delays, cancellations, or schedule changes
Hotel overbooking, room changes, or service issues
Weather-related disruptions or natural disasters
Personal injury, illness, or property damage during travel
Changes in currency exchange rates or government regulations
9. Supplier Terms and Conditions All travel arrangements are subject to the terms and conditions of respective Suppliers. You agree to be bound by these terms, which may include additional limitations of liability.
10. Force Majeure We are not liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, government actions, labor disputes, or public health emergencies.
11. Travel Advisories and Safety Clients are responsible for checking current travel advisories, health recommendations, and safety conditions. We recommend consulting government websites (State Department, CDC) before travel.
12. Intellectual Property All custom itineraries, recommendations, and travel content created by Foritz Travel are proprietary and may not be shared, copied, or distributed without written permission.
13. Privacy Your personal information is handled according to our Privacy Policy, which is incorporated into these terms by reference.
14. Dispute Resolution Any disputes will be resolved through binding arbitration in [Your State/County]. Virginia law governs these terms.
15. Severability If any provision of these terms is deemed invalid, the remaining provisions will continue in full force and effect.
16. Modifications We reserve the right to modify these terms at any time. Continued use of our services constitutes acceptance of modified terms.
